Terminological delibrations and differences on Famous hadith in classical literature and its implications: Analytical review of opinionsof Muhaddithin and Hanafi Jurists
Abstract
“The Well-Known Hadith” (famous Hadith) is a terminology, defined differently by Muhaddiths and Fuqaha. This difference of definition causes the state of multeity (tanawu) and variation in Sharia issues. This multeity shows neologion (ijtihadi) capacity in Fiqhi issues and opens the ways to illation in secondary topics. Similarly, this difference of famous Hadith by Fuqaha clearly illustrates the importance of proof, scale of proof and effects of proof with respect to its scale. This is necessary to review these effects of “Well-Known Hadith” in order to determine a standard direction of Fiqhi and Kalami dissents. This term used often among students of Sacred Law. The conclusion after the review of this case study is that “The Well-Known Hadith” is that which narrated by a lone peson in originals, after that the public adopted it with acceptance. Some times It changes the general situation of Quran& Hadith. This research will clear the meaning of “The Well-Known Hadith” and it’s difference between Hanfis and Muhaddiths.
