An Evaluation of the Decrees of the Schools of Various Schools of Thoughts regarding the Evidence of DNA Test

Abstract

DNA test is a most powerful tool for human identification and has clear forensic applications in identity testing especially in crime scene and parentage determination. The advent of fingerprinting has revoluntionized the science of crime detection. This technique when performed according to strict guidelines is highly reliable not only in convicting criminals but also helps in exonerating innocent individuals. Shortly the development of forensic DNA profiling has an important role in forensic investigations. In this research paper it is tried to determine that DNA test can be used as evidence for which point of views of different Islamic Schools of thought has been analysed and in this regard a questionnaire was developed and sent to different Dar al-Ifta. In the end the view points of differnt schools of thought has been analyzed which shows that DNA test as anevidence is permitted by all of them in the determination of the parentage of a child and permitted by few schools of thought and prohibited by others in cases pertaining to Hudud-o-Qisas especially in rape cases.
